The Platform's initial operations are directed primarily toward the Mexican market; however, the Platform may be accessed and used internationally. By using the Platform, users acknowledge that information may be processed, stored, or transferred to the United States or other jurisdictions where the Company or its service providers operate.

Such information may include athlete names, team affiliations, statistics, rankings, tournament participation, awards, achievements, photographs, videos, and historical sports records.

We may collect information contained in communications sent to the Company, including customer support requests, parental consent requests, copyright notices, privacy requests, dispute submissions, and other correspondence.

INFORMATION ABOUT MINOR ATHLETES

The Platform allows participation by minor athletes.

Athlete profiles belonging to individuals under eighteen (18) years of age are private by default.

Profiles relating to children under thirteen (13) years of age shall be created, managed, controlled, and administered exclusively by a parent or legal guardian.

Profiles relating to athletes between thirteen (13) and seventeen (17) years of age may be managed by the athlete, a parent, legal guardian, or another authorized account administrator, subject to applicable law and Platform policies.

The Company does not knowingly permit children under thirteen (13) years of age to independently create accounts, provide parental consent, manage profiles, or submit personal information without parental involvement.

The Company may retain certain tournament results, rankings, awards, achievements, statistical compilations, and historical sports records relating to minor athletes when necessary to preserve historical accuracy, competition integrity, archival value, legal compliance, or legitimate business interests, even if certain personal information is later restricted, removed, or anonymized.

ACCURACY OF SPORTS INFORMATION

Sports information displayed on the Platform may be provided by athletes, parents, legal guardians, coaches, tournament administrators, leagues, authorized scorekeepers, or other third parties.

IM Sportshistory LLC does not independently verify every statistic, result, ranking, record, or item of sports information published on the Platform.

Accordingly, the Company makes no representation or warranty regarding the accuracy, completeness, timeliness, authenticity, or reliability of all information displayed on the Platform.

Users acknowledge that errors, omissions, disputes, duplications, subjective interpretations, or subsequent corrections may exist.

The publication of statistics, results, rankings, recognitions, or historical records on the Platform does not constitute certification, validation, official approval, auditing, endorsement, or independent verification by IM Sportshistory LLC.

The Company reserves the right, but not the obligation, to investigate, annotate, correct, consolidate, archive, restrict, maintain, or remove sports information when reasonably necessary to preserve data integrity, historical accuracy, competition integrity, legal compliance, or legitimate business interests.

PROCESSING OF MINOR PHOTOGRAPHS

Photographs of minor athletes may only be uploaded to the Platform by:

• The parent or legal guardian responsible for the profile
• An administrator authorized by the parent or legal guardian
• An athlete or account holder legally authorized to manage the profile under applicable law and Platform policies

The Company may retain archived copies of photographs where reasonably necessary for legal compliance, dispute resolution, security purposes, enforcement of Platform policies, protection of rights, or preservation of historical sports records.

The Company does not require photographs to be uploaded and reserves the right to restrict, remove, or replace photographs when a reasonable claim involving privacy, identity, image rights, minor safety, or violation of this Policy is received.

Published photographs shall be used exclusively for sports, historical, statistical, informational, and identification purposes within the Platform.

IM Sportshistory LLC acts solely as a technology provider for the storage and display of photographs uploaded by authorized users. The Company does not participate in the capture, production, editing, consent collection, or ownership determination of images uploaded by third parties.

PHOTO-RELATED COMPLAINTS

Any person who believes that a photograph published on the Platform violates privacy rights, image rights, intellectual property rights, parental consent requirements, or any other legitimate right may submit a complaint to: privacy@imsportshistory.com

The Company may temporarily restrict access to the content while conducting a reasonable review.

Following review, the Company may remove, restrict, replace, maintain, archive, annotate, or otherwise manage the disputed content in its sole discretion and in accordance with applicable law, Platform policies, and legitimate business interests.

CHILDREN UNDER 13 (COPPA)

The Company does not knowingly permit children under thirteen (13) years of age to independently create accounts, provide consent, submit personal information, manage profiles, or otherwise interact with the Platform without parental involvement.

Children under thirteen (13) years of age may participate only through profiles managed by a parent or legal guardian.

Before collecting personal information from a child under thirteen (13), the Company may require verifiable parental consent.

LEGAL BASIS FOR DATA PROCESSING

IM Sportshistory LLC processes personal information based on one or more of the following legal bases:

Profiles of athletes under eighteen (18) years of age shall remain private by default.

The private profile status does not imply the deletion or invisibility of tournament results, aggregated statistics, historical rankings, championships, recognitions, or historical sports records whose preservation is necessary to preserve historical accuracy, competitive integrity, archival value, or legitimate interests of the Platform.

Adult user profiles may be made public when such functionality becomes available and the user elects to do so.

ADVERTISING AND SPONSORS

The Platform may display:

• Advertisements
• Sponsorships
• Business directories
• Promotional content

related to sports activities.

The Company does not sell personal information to third parties.

The presence of advertisements, sponsors, business listings, promotional materials, or sponsored content does not constitute endorsement, recommendation, certification, approval, partnership, or guarantee by IM Sportshistory LLC.

Advertisers and sponsors do not receive access to private account information unless expressly authorized by the user, required by applicable law, or described in this Policy.

ADDITIONAL PROTECTION OF MINORS' DATA

IM Sportshistory LLC does not sell personal information of minors.

The Company also does not share minors' personal information for behavioral advertising, individualized commercial profiling, data monetization, or other commercial exploitation purposes.

Advertising displayed on the Platform may be contextual or general and does not require the sale of minors' personal information.

The Company adopts reasonable measures intended to minimize the collection, use, and disclosure of personal information of minors to that which is strictly necessary for the operation of the Platform, the management of sports activities, and the preservation of historical sports records.

NO COMMERCIAL PROFILING OF MINORS

The Company does not engage in individualized commercial profiling of minors for behavioral advertising, data monetization, or automated decision-making based solely on minors' personal information.

The foregoing does not limit the use of sports information for the generation of statistics, rankings, tournament results, historical records, sports recognitions, statistical compilations, or features inherent to the Platform.

HOSTING AND SERVICE PROVIDERS

The Company may change providers when necessary for Platform operations.

The Platform's technology infrastructure may be modified from time to time for operational, security, scalability, availability, or business continuity purposes. Migration of information to new technology providers shall not constitute a transfer incompatible with the purposes described in this Privacy Policy.

Service providers may have access to information solely to the extent reasonably necessary to perform services on behalf of the Company and are not authorized to use such information for their own independent purposes.

COOKIES AND SIMILAR TECHNOLOGIES

The Platform may use essential cookies necessary for:

• User preferences
• Technical operation

The Platform does not currently use Google Analytics or Meta Pixel.

Users may configure their browser settings to reject or limit cookies, although certain Platform features may not function properly as a result.

NO GUARANTEE OF ABSOLUTE SECURITY

While the Company implements reasonable administrative, technical, physical, and organizational safeguards designed to protect information, no method of transmission over the Internet, electronic storage system, or security procedure can be guaranteed to be completely secure.

Accordingly, IM Sportshistory LLC cannot and does not guarantee absolute security, and users assume the inherent risks associated with electronic communications and online services.

SECURITY MEASURES

The Company implements reasonable administrative, technical, physical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, misuse, destruction, or other unlawful processing.

The Company shall not be liable for losses arising from a user's failure to safeguard account credentials.

SECURITY INCIDENTS

If the Company detects a security incident that may compromise personal information under its control, it may take reasonable measures to investigate, contain, mitigate, and provide notice as required by applicable law.

The Company may cooperate with competent authorities, cybersecurity professionals, service providers, insurers, legal advisors, and affected parties as reasonably necessary to investigate and respond to security incidents.

LIMITED CONTENT MONITORING

Although the Company may review, moderate, or remove content when appropriate, it is under no obligation to continuously monitor all content published by users.

The Company does not guarantee immediate detection of offensive, unlawful, infringing, inaccurate, or inappropriate content.

RETENTION OF SECURITY RECORDS

To protect the Platform, prevent unauthorized access, investigate security incidents, and comply with legal obligations, the Company may retain technical and security logs, including:

• IP addresses
• Access logs
• Authentication logs
• Account activity logs
• Security incident records

Such records may be retained for as long as reasonably necessary for operational, security, auditing, legal compliance, or dispute-resolution purposes.

RETENTION OF PERSONAL INFORMATION

LEGAL HOLD AND DISPUTE PRESERVATION

Notwithstanding any deletion request, the Company may retain information when reasonably necessary to:

One of the essential purposes of the Platform is preserving sports history.

Accordingly, even after account deletion, the Company may retain, archive, preserve, consolidate, correct, annotate, or maintain:

• Tournament results
• Historical rankings
• Records
• Statistics
• Achievements
• Championships
• Awards

when necessary to preserve historical and competitive integrity.

SPORTS DECISIONS AND HISTORICAL RECORDS

The preservation of statistics, results, rankings, records, awards, championships, participation history, and other historical records constitutes a fundamental and legitimate purpose of IM Sportshistory LLC.

The Platform is intended to document, organize, and preserve sports information for historical, statistical, informational, and community-reference purposes.

Accordingly, disputes, disagreements, claims, changes of opinion, conflicts among athletes, parents, legal guardians, coaches, teams, leagues, tournament organizers, or other third parties, as well as account deletion, revocation of consent, or subsequent requests for modification or removal of information, shall not necessarily require the Company to remove, alter, conceal, or modify legitimately preserved historical records.

The Company may maintain, correct, consolidate, annotate, update, restrict, or preserve statistics, results, rankings, championships, awards, and historical records whenever it reasonably determines such actions are necessary to protect the historical, competitive, statistical, archival, or documentary integrity of the Platform.

Final decisions regarding preservation, correction, modification, restriction, or removal of statistics, rankings, results, athlete profiles, and historical records shall be made by IM Sportshistory LLC in good faith, taking into consideration available evidence, competition integrity, historical accuracy, applicable legal obligations, and the legitimate interests of the Platform.

The submission of a complaint or dispute does not guarantee the requested modification, deletion, or correction.

Nothing contained in this Policy shall be interpreted as creating a right to require the deletion, alteration, suppression, or modification of legitimately preserved historical sports records where retention is permitted by applicable law.

ACCOUNT DELETION

Users may request deletion of their accounts by contacting the Company.

Information eligible for deletion shall be deleted, anonymized, or restricted as required by applicable law.

Notwithstanding account deletion, the Company may retain information as necessary to:

• Preserve sports history;
• Maintain historical records;
• Comply with legal obligations;
• Resolve disputes;
• Protect Platform security;
• Prevent fraud;
• Exercise legal rights;
• Preserve evidence.

Retention shall be limited to information reasonably necessary for such purposes.

PARENTAL RIGHTS

Parents or guardians may request:

of information related to minors.

When personal information belongs to a minor athlete, parents or legal guardians may exercise the rights granted to them by applicable law on behalf of the minor.

Subject to applicable legal requirements and reasonable identity verification, parents or guardians may:

• Request access to certain personal information of the minor;
• Request the correction of inaccurate or incomplete information;
• Request the update of information;
• Revoke previously granted consents when legally permissible;
• Request the restriction of certain data processing;
• Request the deletion of information when permitted by applicable law.

The Company may require reasonable documentation to verify the identity and authority of the applicant before processing any request.

RIGHTS OF USERS IN MEXICO (ARCO RIGHTS)

Data subjects located in Mexico may exercise their rights of Access, Rectification, Cancellation, and Opposition (ARCO Rights) in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares) and other applicable provisions.

Where applicable, ARCO requests must contain:

• The name of the data subject;
• Sufficient information to verify their identity or legal representation;
• A clear description of the personal data with respect to which they intend to exercise any right;

The Platform may contain links to third-party websites, applications, services, advertisements, sponsors, commercial directories, or external resources that are not owned, operated, or controlled by IM Sportshistory LLC.

The Company does not control and is not responsible for the privacy practices, security measures, content, availability, policies, or operations of any third-party website or service.

Users access third-party websites and services entirely at their own risk.

The Company does not independently verify all submissions and makes no representation or warranty regarding the completeness, accuracy, reliability, authenticity, legality, or timeliness of any information submitted to or displayed on the Platform.

Users acknowledge and agree that sports-related data may contain errors, omissions, subjective inputs, disputes, duplications, delays, or subsequent corrections, and that such data may be updated or revised over time.

PROFILE, STATISTICS, AND HISTORICAL RECORD DISPUTES

Any athlete, parent, legal guardian, coach, team representative, league operator, tournament administrator, or other affected person who believes that any athlete profile, statistic, ranking, tournament result, historical record, team affiliation, photograph, achievement, award, or other information displayed on the Platform is inaccurate, incomplete, misleading, outdated, unauthorized, improperly attributed, duplicated, or otherwise subject to dispute may submit a written request for review to: legal@imsportshistory.com

The request must include sufficient information to reasonably identify the disputed content, along with any supporting documentation reasonably available.

Upon receipt of a dispute, the Company may, in its sole discretion and without obligation:

• Review the submitted information
• Request additional documentation or clarification
• Consider information provided by relevant third parties
• Annotate or flag disputed records
• Correct or update information where appropriate
• Archive, maintain, or preserve historical information

The Company may, at its discretion, consider information provided by third parties, including tournament organizers, league operators, or data providers, when evaluating disputes. However, the Company is not bound by any external determination.

Submission of a dispute does not guarantee modification, correction, removal, restriction, or resolution in favor of the requesting party.

The Company reserves the right to preserve, archive, and display historical sports records, rankings, and statistical compilations where reasonably necessary to maintain historical accuracy, continuity, integrity, and archival value of sports data and records.

Unless otherwise required by applicable law, the Company’s determination regarding disputed information shall be final and binding within the Platform’s internal processes, subject to applicable law.

The Company does not act as an official referee for sports competitions nor as a certifying sports authority.

ADVERTISING, SPONSORSHIPS, AND PROMOTIONAL CONTENT

The appearance of any advertisement, sponsor, business, organization, team, league, product, service, athlete, coach, tournament, educational institution, or commercial opportunity on the Platform does not constitute an endorsement, recommendation, certification, guarantee, representation, or approval by IM Sportshistory LLC.

The Company does not guarantee the accuracy, legality, safety, availability, quality, suitability, reliability, or performance of any products, services, promotions, offers, opportunities, scholarships, events, businesses, sponsors, advertisers, or third parties featured on the Platform.

Any interaction, communication, transaction, agreement, purchase, registration, participation, or relationship between a user and any advertiser, sponsor, or third party is solely between such parties.

IM Sportshistory LLC shall not be responsible or liable for any loss, damage, injury, dispute, claim, misrepresentation, fraud, contractual issue, or other matter arising from a user’s interaction with advertisers, sponsors, promotional partners, or third parties.

Advertisements may be displayed based on general sports-related interests, geographic regions, tournament participation, team affiliations, or other non-sensitive information consistent with the Privacy Policy.

• Any alleged or actual infringement, misappropriation, or violation of copyrights, trademarks, rights of publicity, rights of privacy, NIL rights, intellectual property rights, proprietary rights, or other legal rights of any person or entity;
• Unauthorized use, publication, submission, or distribution of photographs, videos, athlete information, personal information, statistics, rankings, tournament results, or historical records;
• Manipulation, falsification, misrepresentation, misuse, alteration, or improper submission of statistics, rankings, records, athlete profiles, tournament information, or sports-related data;
• Violations of these Terms and Conditions, the Privacy Policy, Parental Consent Policy, Intellectual Property Policy, DMCA Policy, or any other Platform policies;
• Violations of any applicable law, regulation, court order, governmental requirement, or third-party right;
• Fraudulent, unlawful, misleading, negligent, harmful, abusive, defamatory, harassing, or otherwise improper conduct by the user; or
• Any dispute between the user and any athlete, parent, legal guardian, coach, team, league, tournament organizer, educational institution, recruiter, sponsor, advertiser, photographer, content creator, or other third party arising from or relating to the Platform.

IM Sportshistory LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the user. In such event, the user agrees to cooperate fully with the Company’s defense of such claim.

The obligations set forth in this Section shall survive account suspension, account termination, account deletion, and the user’s discontinuation of use of the Platform.

ARBITRATION AGREEMENT

Any controversy, claim, or dispute arising out of these Terms or related to the Platform shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules.

PARENTAL CONSENT

I acknowledge that the Platform is designed to preserve sports history, statistics, rankings, tournament participation, achievements, awards, records, and other sports-related information.

I understand and authorize the processing of information relating to the minor, including:

PHOTOGRAPHS AND VIDEOS

I authorize the publication, display, storage, and use of photographs and videos of the minor athlete solely for sports, historical, informational, statistical, identification, and community-reference purposes within the Platform.

I acknowledge that photographs and videos may be submitted by authorized users, teams, coaches, leagues, tournament organizers, scorekeepers, parents, guardians, or account administrators.

I understand that IM Sportshistory LLC acts solely as a technology provider and does not produce, capture, direct, or control the creation of such content.

HISTORICAL RECORDS AND SPORTS PRESERVATION

I acknowledge that one of the essential purposes of the Platform is the preservation of sports history.

Accordingly, statistics, rankings, tournament results, awards, championships, participation records, recognitions, and other historical sports information may be retained even if an account is later deleted or consent is subsequently revoked, when such retention is reasonably necessary to preserve historical accuracy, competitive integrity, archival value, legal compliance, or legitimate interests of the Platform.

PRIVATE MINOR PROFILES

I understand that minor athlete profiles are private by default.

The Platform does not intentionally display publicly:

• Home addresses;
• Personal telephone numbers;
• Personal email addresses;
• Government-issued identification numbers;
• Real-time geolocation information.

ACKNOWLEDGMENT REGARDING SPORTS INFORMATION

I understand that statistics, rankings, tournament results, awards, athlete profiles, records, and historical information may be provided by third parties.

I acknowledge that IM Sportshistory LLC does not independently verify every statistic, ranking, result, or historical record published on the Platform and does not guarantee absolute accuracy.

PARENTAL RIGHTS

I understand that I may:

• Review information relating to the minor;
• Request correction of information;
• Request deletion of information where legally required;
• Revoke consent where applicable;
• Submit privacy-related requests.

I acknowledge and agree that this authorization may be executed electronically through the Platform.
